Terms and conditions of sale of the Vaibagalerii online shop



1. Validity of terms and conditions

 

The terms and conditions of sale apply to the sale and purchase of goods and services conducted at vaibagalerii.ee online shop between the purchaser (hereinafter consumer) and the company Virmeton OÜ (hereinafter Vaibagalerii online shop).

The terms and conditions of sale are applied to regulate legal relations between the Vaibagalerii online shop and a private person consumer.

In addition to these terms and conditions, the legal relations arising from the purchase of products from the Vaibagalerii online shop are regulated by the Law of Obligations Act (hereinafter LOA), Consumer Protection Act (CPA) and other legal acts applicable in the Republic of Estonia.

The Vaibagalerii online shop retains the right to amend the terms and conditions of sale. The said amendments are indicated on the website www.vaibagalerii.ee

 

 

2. Price information

 

2.1. All prices in the Vaibagalerii online shop include 20% VAT.

2.2. The prices are valid from the time of placing the order until the expiry of the payment term (7 days after the order is placed)

2.3. If the order is placed before the conditions of sales or prices are amended, the conditions that were in effect when the order was placed are applied to the legal relations arising between the consumer and Vaibagalerii online shop.

2.4. The Vaibagalerii online shop retains the right to amend the sale prices. The said amendments are shown on the website www.vaibagalerii.ee

 

 

3. Placing an order

 

3.1. Add the selected products to the shopping cart.

3.2. In order to place an order, first click “Place order now” (Vormista tellimus) in the shopping cart.

3.3. Next choose if you wish to place the order as a one-time “guest” or as a regular customer (in this case you are required to log in or register as a regular customer).

3.4 On the ordering page, fill in the required information fields, select the suitable shipping and payment method, after which the page displays the order confirmation on the basis of which you can pay according to the previously selected payment method by clicking “Place order now” (Esita tellimus). Before placing the order you can review the terms and conditions of sales of the Vaibagalerii online shop and confirm this with a separate tick. The displayed order confirmation provides you all details to perform the payment in euros with all applicable state taxes and additional fees.

3.5. Fill the boxes on the information and order confirmation page carefully because the quick and proper delivery of your purchased products and the later resolution of disputes and claims, if necessary, depend on the accuracy of the provided information.

3.6. Orders placed in the Vaibagalerii online shop are processed on work days (Mon–Fri 8.00–17.00).

 

 

4. Entry into force of contract of sale

 

4.1. With the contract of sale of a product, the Vaibgalerii online shop undertakes to deliver an existing product, a product to be manufactured or produced or a product to be acquired in the future by the Vaibagalerii online shop to the consumer and to allow the transfer of ownership to the consumer, and the consumer undertakes to pay the price indicated on the invoice for the product to the Vaibagalerii online shop and take delivery of the product.

4.2. Orders that have not been paid for are annulled after 7 days from placing the order.

4.3. The contract of sale comes into effect when the payment performed by the Consumer is accrued in the bank account of the Veebigalerii online shop.



5. Delivery of Goods

 

5.1. After the contract of sale comes into effect, the Vaibagalerii online shop assembles the order and delivers it to the company’s logistics partner for delivery (unless the delivery term “Self pickup” is selected).

5.2. The terms of shipping indicated on the website of the online shop are calculated from the time the order payment is accrued on the bank account of the Vaibagalerii online shop.

5.3. For a due delivery, you should be attentive and submit accurate and valid information upon placing the order.

5.4. The Vaibagalerii online shop is not liable for a delivery delay if the products have been delivered to the logistics partners on time but the delivery delay is caused by circumstances that the Vaibagalerii online shop could not control or foresee.

 



6. Right of return

 

6.1. After receiving the order, the consumer has the right to withdraw from the contract concluded in the online shop without revealing the reason within 14 days. The purchased products are not subject to return if the product has been custom-made or purchased for the customer on a special order. The returned products must be in the original package and unused.

6.2. In order to return the product, submit an application to withdraw from the purchase. You can send the application of withdrawal in free format to the e-mail address vaip@virmeton.ee

6.3. The consumer shall return the product within 14 days as of submitting the application or submit evidence that they have delivered the product to the logistics company during the above period.

6.4 The customer does not have to return the product through the logistics company if the Vaibagalerii online shop has agreed to pick up the product themselves.

6.5. The amount paid for the order is returned to the customer, including the cost of delivery, at the first opportunity but no later than within 14 days as of submitting the application to withdraw from the purchase of the product. If the order is returned in instalments, the delivery cost is returned pro rata to the number of returned products.

6.6. The costs of returning the product are covered by the consumer, except if the delivered product does not conform to the order.

6.7. The amount paid for the order by the customer is not returned before the returned product has arrived in the storage facility of the Vaibagalerii online shop.

6.8. In the case of any deterioration of the goods subject to return, the consumer is liable for the diminished value of the goods only in the case the consumer used the goods in a manner other than what is necessary to establish the nature, characteristics and functioning of the goods. In order to establish the nature, characteristics and functioning of the goods, the consumer should only handle and use the goods in the same manner as the consumer would customarily be allowed to do in a shop.



7. Force Majeure

 

7.1. The Vaibagalerii online shop is not liable for the damage caused to the consumer or the delay of shipping if the damage or delay is due to conditions that the Vaibagalerii online shop could not have controlled or foreseen.

 



8. Processing personal data

 

8.1. By entering data in the online shop and providing the respective confirmation, the consumer gives the right to collect and process the consumer’s personal data (name, contact phone, home address, e-mail address) and forward personal data to the logistics partner for the shipping of products.

8.2. The Vaibagalerii online shop has the right to use the consumer’s address of residence or location to forward advertisements and other information to the consumer.

8.3. The consumer has the right to prohibit the collection and use of their personal data at any time, unless it is necessary for collecting a contractual claim or the delivery of a product.

8.4. Electronic personal data is used for direct mail only if the consumer has granted the respective consent on the website of Vaibagalerii.

8.5. Upon paying for the purchase through a bank’s encrypted data connection the consumer ensures the security of personal bank credentials and the Vaibagalerii online shop does not have access to them.



9. Procedure for submitting complaints

 

9.1. The Vaibagalerii online shop is liable for any lack of conformity or deficiency of the sold product that becomes apparent within two years of the delivery as of the date of the delivery of the thing to the consumer.

9.2. In case a deficiency becomes apparent, the consumer has the right to contact the Vaibagalerii online shop no later than within two months by submitting the invoice on the basis of which the purchase was paid for.

9.3. When a deficiency becomes apparent, the use of the product must be stopped immediately.

9.4. The Vaibagalerii online shop and consumer agree on repairing or replacing a product with deficiencies. The Vaibagalerii online shop covers the costs of repair.

9.5. If a lack of conformity or defect becomes apparent, please forward a complaint to the e-mail address vaip@virmeton.ee with the name of the person who placed the order, contact phone, order number and a detailed description of the lack of conformity or defect.

9.6. The complaint about the lack of conformity or defect must be submitted within two months as of the discovery of the lack of conformity or defect of the product.

9.7. All complaints are reviewed and the consumer is contacted at first opportunity but no later than within 14 days as of receiving the complaint.

9.8. The consumer has the right to request a reduction of the purchase price or a termination of the contract and a repayment of money from the Vaibagalerii online shop if the Vaibagalerii online shop is unable to repair or replace the product or fails to do so, the Vaibagalerii online shop has not removed the defect within a reasonable period of time, unreasonable inconvenience has been caused to the Consumer.



10. Consumer’s right to apply to the Consumer Disputes Committee

 

10.1. If the Vaibagalerii online shop has refused to resolve the consumer’s complaint or the consumer does not agree with the solution provided by the Vaibagalerii online shop and is of the opinion that their rights have been violated or their interests have been impaired, the consumer can file a complaint with the Consumer Disputes Committee through the Consumer Protection Board or with the court. Information about the Consumer Disputes Committee is available on the website of the Consumer Protection Board, for resolving problems that arise in European Union member states, apply to the European Consumer Centre.
